What you will enjoy doing*- In this position, you will manage the prime contract and all commercial and legal aspects of the project after contract award. Additionally, during projectexecution, the Contract Manager supports the project manager, and takesownership of all commercial and legal matters, claims and commercial risk mitigation
- You will also be part of the project team and participate in all relevant project teammeetings
- In this role, you will read, understand and interpret complex EP/EPC contract terms & conditions, and provide guidance to internal stakeholders on contractual obligations and risks
- You will be responsible for supporting the project manager and project team with commercial and legal matters relating to assigned projects
- You will also identify and document commercial and legal risks during project execution and develop action plans to mitigate such risk
- Support and cooperate with the Project Controls team in analyzing project delays
- Proactively pursue preparation, submittal and negotiation of project change orders and claims in close cooperation with Project Manager, including the drafting of all required documentation and notices required in connection therewith
- In this role, you will actively defend client, consortium partner, or third party (e.g. vendor, subcontractor) claims and back charges
- Holding project commercial kick-off meetings is part of your role
- You will submit all milestone payment and other invoices to the client, monitor status of client payments and follow-up on delayed payments
- Also, you will request bank guarantees and parental guarantees and provide to the client
- Providing insurance certificates to the client in accordance with the terms and conditions of the contract will be part of your role
- You will manage and update the contract value and payment plan in SAP-SD
- Coordinate with Tax department and implement tax requirements
- Further, you will coordinate with local authorities and prepare all necessary documentation in accordance with local laws and regulations
- Demand client fulfillment of contractual obligations as well as monitor and follow up on the fulfillment of the client's contractual obligations
- You will also communicate contractual legal and commercial requirements to the project manager and project team, including provision of a summary of terms to internal stakeholders
- Liaise with outside partners (esp. Linde Group companies) auditors and counsel/tax advisors as required
- You will be responsible for handling project-related insurance claims
- Perform financial close-out of project in agreement with Project Controls and Finance department
- Further, you will handle warranty issues for the respective project
What makes you great- You have a Bachelors degree in business, law, finance, construction management, or other related field required. Juris Doctorate, Master of Business Administration or other advanced degree as it is strongly preferred.
- You also have a minimum of four (4) years of experience in the field of contract management, commercial project management, contract administration, subcontract management, or other equivalent experience. International/intercultural experience preferred
- You have the following skills as they are required:
- Highly motivated, self-starter with the ability to work independently with minimal supervision
- Ability to multi-task and prioritize work on multiple assigned projects
- Excellent reading & writing skills, with an acute attention to detail
- Strong sense of responsibility
- Strong verbal communication skills and the ability to work well with and with others within a matrix organization
- Strong negotiation, analytical and problem-solving skills
- Strong organization skills, including the ability to prioritize and plan work
- Past experience supporting project-based business is helpful, but not required
- Working understanding of contract law and risk management principles
- Strong computer skills including Word, Excel, PowerPoint and SAP-SD
