Description:

Brooks Rehabilitation is seeking a dynamic, strategic, and highly skilled General Counsel to lead and manage the legal affairs of our diverse post-acute rehabilitation healthcare system. Reporting to the EVP & CFO, the General Counsel will serve as the senior in-house legal advisor to the organization. Ensuring legal and regulatory compliance, this position will oversee key legal and risk management matters across Brooks’ diverse healthcare operations in support of our operational and strategic initiatives. The ideal candidate will bring deep expertise in contract law, medical malpractice, and healthcare compliance with a strong understanding of the regulatory landscape governing post-acute healthcare systems.

This leader will ensure organizational integrity, protect company interests, and support enterprise growth in a rapidly evolving regulatory landscape.

Responsibilities:

  • Serves as a resource to the leadership team and provides guidance on a wide range of legal matters including the legislation impacting system operations, legal and tax status of Brooks and its affiliate companies, healthcare regulations, contracts, real estate, fraud and abuse, patient care rights, corporate transactions and governance, legal aspects of patient care, and mergers/acquisitions.
  • Negotiates, drafts, and reviews a variety of contracts and legal documents, which may include corporate transaction documents, real estate leases, property and asset acquisitions, joint ventures and other partnership agreements, financing and bond documentation, and other vendor arrangements.
  • Ensure all contracts comply with applicable laws and organizational policies and practices.
  • Collaborate with the Chief Compliance Officer and Risk Management to mitigate liability and exposure.
  • Ensure compliance with federal and state healthcare laws and regulations, including HIPAA, Stark Law, Anti-Kickback Statute, and CMS guidelines.
  • Collaborates in the development of compliance policies and procedures.
  • Leads enterprise-wide general and professional liability risk management strategies to mitigate legal risk and ensure appropriate policies and training are in place.
  • Provide legal guidance on patient care issues, incident reporting, and adverse events.
  • Oversee and manage medical malpractice claims and litigation.
  • Provides input as requested on medical staff matters, including bylaws, medical staff corrective action, and peer review.
  • Acts as a resource as appropriate on revenue cycle matters, including collection and third-party liability issues.
  • Manage external investigations, audits, and litigation matters with outside counsel.
  • Maintains the organization’s legal entities, licenses, and regulatory filings.
  • Oversee contract management including the maintenance of related systems.
  • Maintains relationships with outside counsel and legal service providers when specific outside legal expertise is needed.
  • Monitors the legal budget for the System.

Qualifications:

  • Juris Doctorate (JD) from an accredited law school and admission to practice law in Florida (or eligibility for Florida in-house counsel registration).
  • Minimum of 10 years of legal experience, with a strong background in healthcare law; prior in-house counsel experience preferred.
  • Experience with nonprofit healthcare organizations is highly desirable.
  • Demonstrated expertise in regulatory compliance, contract law, and healthcare operations.
  • Strong knowledge of post-acute care regulations and operations (e.g., SNFs, IRFs)
  • Knowledge of legal issues pertaining to antitrust, acquisitions and other partnership transactions, real estate, tax and intellectual property.
  • Extensive knowledge of laws and accreditation standards governing the delivery of healthcare by providers and suppliers.
  • Strong interpersonal, negotiation, and leadership skills with the ability to communicate effectively with internal and external stakeholders and convey complex legal concepts to non-legal stakeholders.
  • Ability to work independently with minimal supervision.
