Job Description:

We are searching for the best talent for Health Care Compliance Director Mexico Medtech to be in Mexico City, Mexico.

Purpose:

The Director, Health Care Compliance Officer for MT Health Care Compliance / Health Care Business Integrity (HCC/HCBI) program, drive operational excellence, develop, and continuously improve a Compliance framework and program for all MT business in the country with increased scope on public and private markets, both through indirect and direct channels.

The Director will be accountable for driving strategy, enhancement on risk management, collaboration, consistency, and simplification including innovation across the processes within the cluster, serving as the trusted compliance advisor to the cluster leadership team as well as other senior leaders and key stakeholders offering advice, analysis, driving strategic discussion, including new and/or enhanced approaches as per business strategies, activities, and evolving risk across the region.

The Director will have overall responsibility for setting and managing a robust compliance program exercising judgment to mitigate business risk and managing the allocation of resources to support business initiatives. The role serves as a key interface to other Health Care Compliance members at a Corporate and Regional level.

You will be responsible for:

• Set and drive strategy and enhanced approach to HCC/HCBI Program(s) based on business models, activities, and risk profile for MT in the cluster (Business Units or areas).
• Strategic facilitator on Compliance Programs.
• Collaborate with key business and HCC senior leaders to actively support new business models and growth strategies; advising on strategic changes including new and enhanced approaches required to meet current and/or evolving compliance needs, as well as general counseling on complex HCC and Business issues. Support transformational projects.
• Responsible for reviewing complex agreements and commercial arrangements from the HCC perspective in several areas, including distribution, supply, and sales.
• Responsible for building, maintaining and enhancing an effective compliance program in light with the DOJ Guidelines to ensure its business activities comply with HCC/HCBI laws, regulations, industry standards, and company policies related to the promotion and marketing of health care products and services, interactions with health care professionals and/or government officials, including, as applicable, off-label promotion, U.S. anti-kickback and false claims statutes, Foreign Corrupt Practices Act (FCPA) and other anti- corruption laws, compliance with corporate integrity agreements, deferred prosecution agreements, or other settlements, as applicable.
Set strategy and drive continuous enhancement on the compliance program from the prevention, detection, and correction perspectives.
• Engage with seniors’ leaders by providing regular updates to their teams and partnering with key stakeholders to ensure governance and oversight of the compliance program to effectively prevent and/or detect violations of laws, regulations, or company policies, as well as set strategy for all relevant remediations in alignment with Regional and Corporate structures (HCC, GAA & Law Department).
• Influence the external environment to help shape policies and bring insights into the organization through active partnership with law department, GA& P and industry groups and associations.
• Lead and drive the HCC Committee process and strategic agenda to ensure relevant compliance requirements and updates are shared with leaders of the relevant business units.
• Act as a consultant, adviser, and approver, as needed, for business activities involving HCC risks.
• Active member of Leadership teams acting as first line of compliance communication to the business senior leaders, to ensure appropriate review projects and initiatives.
• Enable compliant business growth by ensuring the Sector HCC team at a cluster level partners with the Law Department and HCC peers to help the business navigate through risks associated with engagements with Health Care Professionals, Government Officials, and related entities; new business models; designing controls into business processes to mitigate risks; and ensuring the implementation of these controls.
• In collaboration with HCC Global Operations, Policy, Training Communication provide strategic direction and oversight of HCC/HCBI policies/procedures, education, training, and communications on HCC/HCBI requirements to all relevant employees.
• Respond to complaints and reports of potential misconduct through appropriate investigations and escalations, consistent with Company policies and procedures. Advise HCC Senior Management and business stakeholders of potential compliance risks, compliance related incidents and investigations, trends, root causes, and recommend and implement appropriate action plans.
• Partner with HCC Global Operations in developing and implementing the annual HCC testing & monitoring program and provide oversight of management action plans and corrective actions to close gaps identified during risk reviews, testing and monitoring.
• Lead and mentor Manager/Professionals within HCC, fostering a high-performance culture within team members.
• Design and implement performance objectives and development plans to ensure continued high levels of motivation, capability, and delivery.
• Responsible to align with key stakeholders on HCC priorities, training and educational needs and consistent compliance efforts.
• Influence the external environment to help shape policies and bring insights into the organization through active partnership with law department, GA& P and industry groups and associations.
• Actively engage in the enterprise-wide Talent Management process for HCC.

Qualifications / Requirements:

Required Minimum Education:
Bachelor's Degree
Postgraduate Degree

Required Years of Related Experience: minimum of 10 years business experience including a minimum of 5 years’ experience and demonstrated leadership in HCC or related compliance function.

Required Knowledge, Skills and Abilities:

Strong communication and influencing skills. Interaction with senior executives (CLT).
Deals well with ambiguity and demonstrates strong organizational, process and interpersonal skills.
